These Terms of Service govern your use of Pixair AI, operated by Pixair ("we", "us", or "our"). By accessing or using the Service at pixair.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to update these terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

Pixair AI provides an AI-powered product photography service that allows users to upload product images and generate professional-quality photos with various backgrounds, styles, and settings. The Service is provided on a subscription or pay-per-use basis.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

4. Subscriptions and Payments

• Subscription fees are billed in advance on a monthly or annual basis.
• Payments are processed by Paddle. By subscribing, you agree to Paddle's terms of service.
• All fees are non-refundable except as required by law or stated otherwise.
• We reserve the right to change pricing with 30 days notice to active subscribers.
• Free tier usage is subject to limits and may be changed or removed at any time.

5. Acceptable Use

You agree not to use the Service to:

• Upload content that is illegal, harmful, threatening, abusive, or infringes on third-party rights.
• Generate images of people without their consent.
• Attempt to reverse-engineer, copy, or resell the Service or its underlying AI models.
• Use automated tools to abuse rate limits or overload the system.
• Misrepresent AI-generated images as unaltered photographs in a deceptive manner.

6. Intellectual Property

Your content: You retain ownership of the product images you upload. By uploading content, you grant Pixair AI a limited license to process your images solely to provide the Service.

Generated images: You own the AI-generated images produced from your uploads, subject to the licenses of the underlying AI models and these terms.

Our platform: All software, design, trademarks, and content of the Pixair AI platform remain the exclusive property of Pixair AI.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that generated images will meet your specific requirements. AI outputs may occasionally be inaccurate or unexpected.

8. Limitation of Liability

To the maximum extent permitted by law, Pixair AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim arising from these terms shall not exceed the amount you paid us in the 3 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our sole discretion. You may cancel your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms shall be resolved through binding arbitration or in courts of competent jurisdiction.
